5. Collection and storage of personal data as well as the type and purpose of their use

a) When visiting the website

When you visit this website, the browser used on your device automatically sends information to the server on my website. This information is temporarily stored in a so-called log file. The following information is recorded without any action on your part and stored until it is automatically deleted:

b) When using the contact form

If you have any questions, I offer you the opportunity to contact me using a form provided on the website. It is necessary to provide a valid email address so that I know who sent the request and to be able to answer it. Further information can be provided voluntarily. The data processing for the purpose of contacting me takes place in accordance with Art. 6 Para. 1 S. 1 lit. a GDPR on the basis of your voluntarily given consent. The personal data collected by me for the use of the contact form will be automatically deleted after your request has been dealt with.

c) When using the Carbon Credit Calculator: you may select the automated way to calculate the potential value of the Carbon Credits by uploading a document (iSFP), we use Replit, an online software development and hosting platform operated by Replit, Inc., 767 Bryant Street, Suite 210, San Francisco, CA 94107, USA.

If you choose to use the carbon credit calculator that involves interactive forms, automated evaluations, or dynamic calculations (e.g., estimating carbon credit potential), the data you submit (such as project details or energy consumption data) may be temporarily processed through a backend environment hosted on Replit’s infrastructure.

Replit may therefore gain technical access to limited personal or project-related data as part of this processing. Data is processed solely for the purpose of providing the requested service and is not used by Replit for its own purposes. Data processed via Replit is secure and handled in compliance with European data protection standards.

Please note that Replit is a US-based service provider. Where data transfers to the United States occur, they are protected either through standard contractual clauses (SCCs) approved by the European Commission or other recognized legal safeguards.

If you use the calculator by entering data manually, the data will be stored on Google Drive.

The Data provided will be stored in AWS on servers based in Europe.

 

6. Transfer of data

A transfer of your personal data to third parties for purposes other than those listed below does not take place.

I will only pass on your personal data to third parties if:

- you have given your express consent in accordance with Art. 6 Para. 1 S. 1 lit.

- you are interested to have a quick automated evaluation of the value of the certified CO² emissions reductions you expect to achieve with a retrofit or an energetic renovation.

- the transfer according to Art. 6 Para. 1 S. 1 lit.f GDPR is necessary to assert, exercise or defend legal claims and there is no reason to assume that you have an overriding legitimate interest in not disclosing your data,

- in the event that there is a legal obligation for the transfer according to Art. 6 Para. 1 S. 1 lit.

- this is legally permissible and required according to Art. 6 Para. 1 S. 1 lit. b GDPR for the processing of contractual relationships with you.

7. Transfer of Data to External Auditors for Certification

In order to verify and certify carbon credits in accordance with recognized international standards, the data you submit as part of your application to our carbon credit program must be audited by accredited Validation and Verification Bodies (VVBs).

We currently cooperate with Earthood and TÜV Nord as independent third-party auditors. These organizations are responsible for assessing the eligibility, accuracy, and compliance of submitted data with the applicable carbon credit methodologies (e.g., as defined by registries such as VERRA).

By applying for the development of carbon credits through Radical Zero, you consent to the transfer of your submitted data to these external auditors for the purpose of verification and certification. You also acknowledge that these auditors may contact you directly, if necessary, in order to complete the audit process.

The transfer of data to these partners is carried out strictly for the above-mentioned purpose, under the legal basis of Art. 6(1)(b) and (f) GDPR, and in accordance with data protection and confidentiality obligations.

I use cookies on my website. These are small files that your browser automatically creates and that are stored on your device (laptop, tablet, smartphone, etc.) when you visit my site. a) Tracking tools
The tracking measures listed below and used by us are carried out on the basis of Art. 6 Para. 1 S. 1 lit. With the tracking measures used, I want to ensure a needs-based design and continuous optimization of my website. On the other hand, I use the tracking measures to statistically record the use of my website and to evaluate it for you in order to optimize my offer. I use social plugins from the social networks Facebook, Instagram on my website on the basis of Art. 6 Para. 1 S. 1 lit. The underlying advertising purpose is to be regarded as a legitimate interest within the meaning of the GDPR. Responsibility for the data protection-compliant operation is to be guaranteed by the respective provider.
a) Facebook
Social media plugins from Facebook are used on my website to make their use more personal. For this I use the "LIKE" or "SHARE" button. This is an offer from Facebook. When you call up a page on my website that contains such a plugin, your browser establishes a direct connection with the Facebook servers. The content of the plugin is transmitted directly from Facebook to your browser, which integrates it into the website. By integrating the plugins, Facebook receives the information that your browser has accessed the corresponding page of my website, even if you do not have a Facebook account or are not currently logged into Facebook. Verantwortliche Stelle ist die natürliche oder juristische Person, die allein oder gemeinsam mit anderen über die Zwecke und Mittel der Verarbeitung von personenbezogenen Daten (zB. Namen, E-Mail-Adressen o. Ä.) entscheidet.

3. Widerruf Ihrer Einwilligung zur Datenverarbeitung

Viele Datenverarbeitung Vorgänge sind nur mit Ihrer ausdrücklichen Einwilligung möglich. Sie können Ihre Einwilligung jederzeit widerrufen. Dazu genügt eine formlose E-Mail an uns. Die Rechtmäßigkeit der bis zum Widerruf erfolgten Datenverarbeitung Vorgänge bleibt vom Widerruf unberührt.

Beschwerderecht bei der zuständigen Aufsichtsbehörde

Im Falle datenschutzrechtlicher Verstöße steht dem Betroffenen ein Beschwerderecht bei der zuständigen Aufsichtsbehörde zu. Zuständige Aufsichtsbehörde in datenschutzrechtlichen Fragen ist der Landesdatenschutzbeauftragte des Bundeslandes, in dem unser Unternehmen seinen Sitz hat. Recht auf Daten Übertragbarkeit

Sie haben das Recht, Daten, die wir auf Grundlage Ihrer Einwilligung oder in Erfüllung eines Vertrags automatisiert verarbeiten, an Sie oder an einen Dritten in einem gängigen, maschinenlesbaren Format aushändigen zu lassen. Sofern Sie die direkte Übertragung der Daten an einen anderen Verantwortlichen verlangen, erfolgt dies nur, soweit es technisch machbar ist.

Diese Seite nutzt aus Gründen der Sicherheit und zum Schutz der Übertragung vertraulicher Inhalte, wie zum Beispiel den Anfragen, die Sie uns als Seitenbetreiber senden, eine SSL-Verschlüsselung. 5. Erhebung und Speicherung personenbezogener Daten sowie Art und Zweck ihrer Verwendung

a) Beim Besuch der Website

Beim Aufrufen dieser Website werden durch den auf Ihrem Endgerät zum Einsatz kommenden Browser automatisch Informationen an den Server meiner Website gesendet. Diese Informationen werden temporär in einem sogenannten Log File gespeichert. Folgende Informationen werden dabei ohne Ihr Zutun erfasst und bis zur automatisierten Löschung gespeichert:

- IP-Adresse des anfragenden Rechners,

- Datum und Uhrzeit des Zugriffs,

- Name und URL der aufgerufenen Datei,

- Website, von der aus der Zugriff erfolgt (Referrer-URL),

- verwendeter Browser und ggf. das Betriebssystem Ihres Rechners sowie der Name Ihres Access-Providers.

Die genannten Daten werden durch mich zu folgenden Zwecken verarbeitet:

- Gewährleistung eines reibungslosen Verbindungsaufbaus der Website,

- Gewährleistung einer komfortablen Nutzung unserer Website,

- Bewertung der Systemsicherheit und -stabilität sowie

- zu weiteren administrativen Zwecken.

Rechtsgrundlage für die Datenverarbeitung ist Art. 6 Abs. 1 S. 1 lit.f DSGVO. Mein berechtigtes Interesse folgt aus oben aufgelisteten Zwecken zur Datenerhebung. In keinem Fall verwende ich die erhobenen Daten zu dem Zweck, Rückschlüsse auf Ihre Person zu ziehen. Darüber hinaus setze ich beim Besuch meiner Website Cookies sowie Analyse Dienste ein. Nähere Erläuterungen finden Sie unter Ziffern 4 und 5 dieser Datenschutzerklärung.

b) Bei Nutzung des Kontaktformulars

Bei Fragen jeglicher Art biete ich Ihnen die Möglichkeit, mit mir über ein auf der Website bereitgestelltes Formular Kontakt aufzunehmen. Dabei ist die Angabe einer gültigen E-Mail-Adresse erforderlich, damit ich weiß, von wem die Anfrage stammt und um diese beantworten zu können. Weitere Angaben können freiwillig gemacht werden. Die Datenverarbeitung zum Zwecke der Kontaktaufnahme mit mir erfolgt nach Art. 6 Abs. 1 S. 1 lit. 6 Abs. 1 S. 1 lit. a DSGVO auf Grundlage Ihrer freiwillig erteilten Einwilligung. Die für die Benutzung des Kontaktformulars von mir erhobenen personenbezogenen Daten werden nach Erledigung der von Ihnen gestellten Anfrage automatisch gelöscht.

6. Weitergabe von Daten an externe Prüfer zur Zertifizierung von Carbon Credits

Um CO₂-Zertifikate gemäß anerkannten internationalen Standards verifizieren und zertifizieren zu lassen, müssen die von Ihnen im Rahmen Ihrer Bewerbung für unser Carbon-Credit-Programm eingereichten Daten von akkreditierten Validierungs- und Verifizierungsstellen (Validation and Verification Bodies, VVBs) geprüft werden.

Wir arbeiten derzeit mit den unabhängigen Prüfstellen Earthood und TÜV Nord zusammen. Diese Organisationen sind dafür verantwortlich, die Förderfähigkeit, Richtigkeit und Übereinstimmung der bereitgestellten Daten mit den jeweiligen Methoden der CO₂-Zertifizierungsprogramme (z. B. VERRA) zu bewerten.

Mit Ihrer Bewerbung zur Entwicklung von Carbon Credits über Radical Zero erklären Sie sich damit einverstanden, dass Ihre eingereichten Daten zu Prüfzwecken an diese externen Auditoren weitergegeben werden. Sie stimmen außerdem zu, dass diese Auditoren Sie gegebenenfalls direkt kontaktieren dürfen, um den Zertifizierungsprozess abzuschließen.

Die Weitergabe der Daten erfolgt ausschließlich zu den genannten Zwecken und basiert auf den Rechtsgrundlagen des Art. 6 Abs. 1 lit. b und lit. f DSGVO, unter Beachtung der geltenden Datenschutz- und Vertraulichkeitsvorschriften.

 

7. Übermittlung von Daten

Eine Weitergabe Ihrer personenbezogenen Daten an Dritte zu anderen als den unten aufgeführten Zwecken findet nicht statt.

Ich gebe Ihre personenbezogenen Daten nur an Dritte weiter, wenn:

- Ihre ausdrückliche Einwilligung nach Art. 6 Abs. 1 S. 1 lit.

- Eine Weitergabe erfolgt insbesondere dann, wenn Sie eine automatisierte Einschätzung Ihrer potenziellen Einnahmen durch die Entwicklung und den Verkauf von Carbon Credits beantragen. In diesem Fall werden die dafür erforderlichen Angaben (z. B. zu Ihrem Gebäude, geplanten Maßnahmen oder Energiedaten) an technische Dienstleister oder Partnerunternehmen übermittelt, die die Berechnung durchführen.

- die Weitergabe nach Art. 6 Abs. 1 S. 1 lit. f DSGVO zur Geltendmachung, Ausübung oder Verteidigung von Rechtsansprüchen erforderlich ist und kein Grund zur Annahme besteht, dass Sie ein überwiegendes schutzwürdiges Interesse an der Nichtweitergabe Ihrer Daten haben,

- für den Fall, dass für die Weitergabe eine gesetzliche Verpflichtung gem. 6 Abs. 1 S. 1 lit.

- Dies ist gesetzlich zulässig und nach Art. 6 Abs. 1 S. 1 lit. b DSGVO zur Abwicklung von Vertragsverhältnissen mit Ihnen.

8. Nutzung von Replit zur Datenverarbeitung

Für bestimmte Funktionen und Dienste auf unserer Website  (Carbon Credit Calculator) verwenden wir Replit, eine Online-Plattform für Softwareentwicklung und Hosting, betrieben von Replit, Inc., 767 Bryant Street, Suite 210, San Francisco, CA 94107, USA.

Wenn Sie Funktionen nutzen, die automatisierte Berechnungen oder dynamische Auswertungen beinhalten (z. B. zur Schätzung des CO₂-Minderungspotenzials), können die von Ihnen übermittelten Daten (iSFP) vorübergehend über eine Backend-Umgebung verarbeitet werden, die auf der Infrastruktur von Replit gehostet wird.

Replit kann im Rahmen dieser Verarbeitung technischen Zugriff auf bestimmte personenbezogene oder projektbezogene Daten erhalten. Die Verarbeitung erfolgt ausschließlich zum Zweck der Bereitstellung der angefragten Funktionalität. Replit nutzt diese Daten nicht für eigene Zwecke. Alle über Replit verarbeiteten Daten werden sicher und im Einklang mit den europäischen Datenschutzstandards behandelt werden.

Bitte beachten Sie, dass Replit ein Dienstleister mit Sitz in den USA ist. Sofern es zu einer Übermittlung von Daten in die Vereinigten Staaten kommt, erfolgt diese auf Grundlage von Standardvertragsklauseln (SCCs) der Europäischen Kommission oder anderen anerkannten Garantien gemäß DSGVO.
